Terms of service

The following terms and conditions apply to all orders placed by customers via our online shop.

Contractual partner

The purchase contract is concluded with Happy3 GmbH.

Product range

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. In particular, changes in design and technology, which improve the functionality of a product, as well as errors in description, illustration and pricing are reserved. All technical information on the individual goods is based on the manufacturer's specifications and is binding within this framework.
You can initially place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order. By clicking on the order button, you place a binding order for the goods contained in the shopping basket. The customer's order can also be placed by telephone, in writing or by e-mail. Happy3 GmbH accepts the order by sending the customer an order confirmation by e-mail.

Delivery conditions

In addition to the indicated product prices, shipping costs may be added. You can find out more about the shipping costs in the offers.

Payment terms

PayPal
If you select payment via PayPal, the payment details you enter will be transmitted to PayPal. During the ordering process, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, legitimise yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal. You will receive further instructions during the ordering process.
Bank transfer (prepayment) with payment slip
We offer purchase on account as a payment option. The invoice is sent by e-mail and is due immediately after conclusion of the contract, unless the parties have agreed a later due date. The goods will not be dispatched until payment has been received.
Credit card
When you place the order, you can also pay with a valid credit card and enter the credit card information.
Cash payment is not possible.

Reservation of title

The goods remain the property of Happy3 GmbH until full payment has been made.

Transport damage

If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.

Limited liability of the seller

Any liability of the seller towards the buyer and any additional drivers for any kind of contractual and/or non-contractual personal injury and/or property damage is expressly excluded.

Warranty for defects, liability, guarantee and right of return

The Swiss Code of Obligations applies. The statutory provisions on the purchase contract (Art. 184 ff. CO) apply.

Applicable law and place of jurisdiction

The contract is governed exclusively by Swiss law. The place of jurisdiction for all disputes between the buyer and seller in connection with the tenancy is Basel-Stadt.
